IBLS Announces DIPLOMA in OFFSHORE E-COMMERCE LAW II

After international success of the first online Diploma in Offshore E-Commerce Law, IBLS is pleased to announce a new 8 week Intensive Program which will start on June 6th, 2005, and will deliver a Diploma in E-Commerce Offshore Law II.

The Diploma in Offshore E-Commerce Law has been developed and customized with the specific needs of global online community in mind - timely information that can be immediately used for e-business practice. Experts and experienced practitioners, from around the world, have designed the course modules and materials.

E-COMMERCE Update on MERCOSUL

The MERCOSUL (or the South American Common Market Agreement, according to its Portuguese acronym; in Spanish, “MERCOSUR”), created in 1991 as one of the most important Latin American regional economic blocks, consists of member countries Brazil, Argentina, Paraguay, Uruguay, Chile, and Bolivia. MERCOSUL’s member states have placed the issue of e-commerce high on their common agenda, given its importance in generating commerce, and the need to address growing digital economy. MERCOSUL is currently analyzing e-commerce within the bloc, along with the obstacles to its greater implementation, and solutions to overcome those obstacles.

The CMC created 14 active SGTs. SGT-13 is the advisory committee assigned to e-commerce issues for MERCOSUL. Among the SGT-13’ objectives are, (i) coordinating of the state members’ national policies regarding e-commerce and its related topics; (ii) streightening the e-commerce relationship among MERCOSUL members; (iii) improving of the e-commerce regulatory framework; and (iv) developing e-commerce relations among the member states.

The MERCOSUL countries are already developing this harmonizing and regulatory framework through the SGT-13 meetings, and the public and private sector discussions therein. The MERCOSUL countries in this way are pursuing simultaneous, collective, and individual efforts to resolve many of the crucial issues affecting e-commerce.

Quarterly Theme - Online Contracting - CANCELLATION OF AN ELECTRONIC CONTRACT UNDER FRENCH LAW

Continuing with this month's newsletter, IBLS is presenting a quarterly theme on the most important aspects of Internet and E-Commerce Law. A selected theme is covered in a special summary from the IBLS database./The IBLS Database has thousands of summaries covering a wide range of legal issues related to the Internet and E-Commerce organized by practice area, region, or business category./ This quarterly theme, Online Contracting, looks at CANCELLATION OF AN ELECTRONIC CONTRACT UNDER FRENCH LAW.

As a general principle applicable to any kind of agreement under French law (including electronic contract), a contract that is cancelled ceases to have effect for the future. Causes for cancellation are numerous. For instance, an international contract might be cancelled because French public order ("ordre public") is violated. In the context of electronic commerce, the cancellation of a contract also frequently results from the non-compliance with consumer protection laws.
