A selected theme is covered in a special summary from the IBLS database. This month's summary focuses on the challenges in regulating online contracting in different global jurisdiction, with the focus on the United States and European Union.
Many jurisdictions have been setting general legal framework in order to resolve issues connected to the development of the Internet, such as electronic authentication, the validity of electronic contracts and other electronic documents, etc. Following the work of the United Nations Commission on International Trade Law (“UNCITRAL”), the US and the EU have adopted a different approach in this respect.
