IBLS, a portal to global Internet and E-Commerce Law, is pleased to announce the launch of its Global E-Commerce Council (GECC) during the United Nations World Summit on the Information Society held in Geneva, December 10-12, 2003.
IBLS, an accredited participant at the UN Summit, has assumed its role in the information society landscape as an enabler of open exchanges of information for furthering global eBusiness. It is the use of IT and electronic communication networks to exchange business information and conduct global transactions in electronic form which IBLS is paving the legal framework in.
"This is a set of technologies which will be hugely democratic. The Internet is a basis for
citizen-to-citizen connections. A good example is the landmines treaty,
which essentially happened because citizens around the world connected via
the Internet and pressured governments to create a ban." commented Nitin Desai, Special Advisor of UN Secretary-General Kofi Annan on the World Summit on the Information Society
IBLS supports the UN goal of democratic technology. “We see the value that the Internet has in all aspects of our lives”, “Yet, to just wire a country for access is only half the solution. We need to help everyone quickly catch up with the global plethora of the laws and regulations of doing business online.”, commented Ana Penn, CEO of IBLS.

One of the most unique aspects of the GECC is the members’ ability to ask specific questions regarding a country’s Internet regulations and have these questions answered by experts within that country’s governing body. THE GECC has brought on board numerous countries who are will to contribute to a greater understanding of their country’s Internet regulations.
Membership in the council is open to those in business, law, or government with a stake in ensuring that future developments of Internet regulation takes into account their perspectives.

Quarterly Theme - Taxation of Offshore E-Commerce Continuing with this month's newsletter, IBLS is presenting a quarterly theme on the most important aspects of Internet and E-Commerce Law. A selected theme is covered in a special summary, or an article from the IBLS database. This quarterly theme, Offshore E-Commerce, looks at financial centers located offshore and the tax issues associated with them.
The International Offshore Financial Centers (“IOFC”), generally do not have double tax treaties. This is because they usually have very low or no corporation tax. Some companies have occasionally attempted to escape tax by earning profits in subsidiary companies in IOFCs and not passing that profit on to the parent company.
However, most high-tax countries have anti-avoidance (controlled foreign company) laws which would attribute such income to the parent company. Keeping this mind, there are numbers of questions arises with respect to offshore taxation of e-commerce. For example the tax issues that affect U.S. persons who want to do business outside the U.S. One thing that is obvious, is that the U.S. government would not be making is easy for U.S. persons to avoid paying income taxes by merely rent or lease a space on a computer in an offshore island tax haven such as Bermuda and then operates that remote computer over the Internet from an office or home in the US.
There are going to be number of issues that perhaps will make these transactions difficult for the US persons to attempt in avoiding US taxes on his/her global e-commerce business.

Adriana Lynch Joins IBLS as Chief Marketing Officer IBLS is pleased to announce the addition of Adriana P. Lynch to the IBLS management team. Ms. Lynch joins IBLS as Chief Marketing Officer.
With 12 years of experience in Strategy and Brand Management, Ms. Lynch has held management positions with The Walt Disney Co., Häagen-Dazs, Pillsbury International, Procter & Gamble, and Citibank.
After receiving her MBA from Harvard, graduating in 1996 with Second Year Honors, Ms. Lynch gained international marketing experience throughout Asia, Russia, Middle East, Greece, Israel, and Latin America.
Ms. Lynch expertise in Advertising, Brand Building, and New Product Development, has granted her many successful endeavors, such as the launch of Häagen-Dazs Dulce de Leche, the repositioning of Progresso Soups in the US, and the devising of a two tiered strategy for Pampers in underdeveloped countries.
Most recently, Ms. Lynch was the Director of Brand Management for the Disneyland Resort, responsible for the long term Brand strategies, and the opening plans for Disney’s California Adventure, Downtown Disney and the Disney’s Grand Californian Hotel.
