| | | The United States (US) Food and Drug Administration (FDA) and the Federal Trade Commission (FTC) are the government agencies regulating and controlling the sale of prescription drugs in the US. US online sites illegally dispensing prescription drugs may face liability and be the subject of lawsuits filed by any of these agencies, specially the FTC. Likewise, private auction sites are contribute to controlling the sale of prescription drugs in the US by assuring that its customers do not list these items in their websites. This article provides information on the online sale of prescription drugs in the United States.

| | | The Internet, slowly but steadily, is defying every area of law, including professional regulatory practice. State statutes, in most states, regulate the prescription of medicines by licensed physicians as a matter of public concern. Even though most of the statutes have not been adapted to regulate physicians dispensing services on the Internet, courts are willing to construe these statutes, called remedial statutes, to meet the cases that are within the reason or the spirit of the law. Following there is an example on how the Missouri Court of Appeals affirmed an administrative decision banning a physician from prescribing medicine over the Internet.

| | | Various European Community laws are applicable to the issue of Internet pharmacies and their supply of medical products to buyers located in other Member States. For instance, the E-commerce Directive 2000/31/EC; the provisions of the Distance Sales Directive 97/7/EC; Directive 2001/83/EC regarding medicinal products for human use; Directive 92/28/EEC on advertising of medicinal products in the EU and currently part of the Community Code; and laws applicable to the free movement of goods throughout the Member States. Besides these community laws, domestic laws of the Member States may also play an essential role in deciding any particular case on Internet pharmacies and their supply of products to individuals located in other EU countries. This article presents the EU policies on this topic as enunciated by Court of Justice of the European Community in a 2003 case (2003 ECR I-14887). [More...] |
