INTERNET LAW - Consumer Liability for Unauthorized e-Fund Transfers

 The Electronic Fund Transfer Act ("EFTA") is the framework for the electronic fund transfer system in the United States ("US"). EFTA establishes the rights, liabilities, and responsibilities of the parties to this e-system. As EFTA § 1693 notes, the primary objective of this Act is the provision of individual consumer rights. Surprisingly enough, most Americans do not know their rights, responsibilities, and liabilities when conducting electronic fund transfers, even though this has become a usual practice. This article illustrates on the consumer liabilities for unauthorized e-fund transfers.

INTERNET LAW - Online Payment Scams Growing in Europe According to EU Report

 As the Internet increases in range and wealth of business opportunities, so do criminals up their efforts to develop more sophisticated and effective ways to scam online. Net credit card fraud is growing in Europe, according to an official European Commission report on the web sector, called "Report on fraud regarding non cash means of payments in the EU: the implementation of the 2004-2007 EU Action Plan.” The report sums up the problem, saying: “Fraud against means of payment (payment fraud) remains a threat to the success of the internal market for payments. Payment fraud affects the consumer confidence in non-cash means of payment and ultimately the real economy.”

 New developments in the secured credit laws of major U.S. trading partners such as Japan, China and France, the new UNCITRAL Legislative Guide on Secured Transactions and the OAS Model Inter-American Law on Secured Transactions are rapidly changing the legal landscape for international trade, project finance, securitizations and other uses of secured credit. This conference will bring together prominent academics, international experts and practitioners, including key drafters of the UNCITRAL Legislative Guide and OAS Model Law, to discuss the important policy issues in harmonizing the secured credit laws of diverse legal systems, and what the future holds for secured transactions law in a global economy.

INTERNET LAW - Turkish Supreme Court Held that Banks are sole Responsible for Theft in Electronic Banking

 For the first time, Turkish Supreme Court, 11th Circuit held that banks are sole responsible for theft in electronic banking. In this case Plaintiff claimed that defendant bank should indemnify him for his losses arising from theft during the process of electronic banking transactions.

 Even if you’re really mad…it may not be such a good idea to hack, that is, to illegally access another’s computer. The pursuit of electronic evidence to reach beneficial divorce settlements and close lucrative business deals was reportedly out of control in some United Kingdom circles…until law enforcement officers decided to look into the activities of a well-known heir. After being questioned by the police, the heir and his detectives recently ended in a London Court.

 The United States (U.S.) Federal Trade Commission has published an Electronic Banking (also known as Electronic Funds Transfers- EFT) Brochure to educate consumers on their rights when using electronic payment methods. This Brochure is a straightforward and simple guide that most consumers should use, especially after this Holiday season. In the FTC Brochure on electronic banking users find information on what types of disclosures they must received from their banks; how to file a complain when an error has occurred, what are the appropriate institutions to file these complaints and, among others.
