The Protection Of Databases’ Content Under French Law

Databases are protected under European law by the Directive on the Legal Protection of Databases of March 11, 1996, which was implemented under French law by the law of July 1, 1998. This protection enables European database companies to prevent unauthorized acts of extraction and of re-utilization of the content of their databases.

The following questions have been addressed in this article:

What protection is granted under French law?
Did the Courts define the notion of “substantial investment”?
Does this legal protection also benefit non-European databases?
