Defamation On The Internet Under French Law

Defamation on the Internet is currently a big issue under French law. Since most of the time, the authors of defamatory statements posted on the Internet cannot be identified, Courts tend to hold the interactive forum hosts liable for these statements. In spite of the adoption of a law that limits the liability of Internet Service Providers (“ISP”), Courts still view Interactive forum hosts, moderated or un-moderated, as responsible for the editorial control over the content of their forums.
