How To Transfer Electronic Personal Data From Europe To The United States

The European Data Protection Directive strictly regulates personal data collection, processing and transfer. Pursuant to this Directive, personal data can only be transferred to countries outside the E.U. that guarantee an adequate level of protection. The U.S. are not considered as having an adequate level of protection. Therefore, U.S. companies willing to transfer personal data from the E.U. must comply with either the “Safe Harbor” or the “Model Contract” alternative.
