Whether Hyperlinks To Pirated Material Constitutes Copyright Infringement

The Recording Industry sued MP3board.com in federal court for copyright infringement based on their hyperlinks to pirated material. A U.S. District Court in the Southern District of New York has determined that summary judgment is not available to either of the parties. This case was a pioneer case because it dictates that the fact whether or not hyperlinks that allow pirated material can potentially constitute copyright infringement and therefore this case has a triable issue of fact.
