Companies have a strong vested interest in regulating the exchange of electronic mail system whether it be incoming or outgoing messages. Companies have a strong interest in knowing how their employees are using their system and what information is being exchanged. The use of the electronic mail system may lead to the disclosure of trade secrets, harassment and hostile environment claims, copyright penalties of exchanging copyrighted information, criminal penalties and harm to a company’s reputation and position in litigation.
