Click Wrap Agreements And The Computer Fraud And Abuse Act

Contracts have entered a new form in the electronic age with the invention of the Internet. These click-wrap agreements are proving to be more common online. This decision of Register.com, Inc. v. Verio, Inc., 126 F. Supp. 2d 238 (S.D.N.Y., December 12, 2000) was revolutionary, because it involved the enforceability of click-wrap agreements and the Computer Fraud Abuse Act. The case involved a publicly available database of names, addresses, telephone numbers and e-mail addresses and whether or not consent was made regarding the terms of the click-wrap agreement.
