Online Sales of Wine

Cherry Hill Vineyard, LLC, and Philip Brooks, filed a civil action seeking a declaration that certain sections of Maine Rev. Stat. Title 28-A §§ 1361(4), 2077, and 2077-B are unconstitutional as they prevents out-of-state wineries from selling and delivering wine directly to consumers in Maine. The Magistrate judge in Maine rejected the Plaintiffs’ claim that Maine discriminated against them by allowing only in-state wineries to ship wine directly to consumers in Maine.
