Overview of Internet Gambling in Canada

The Criminal Code of Canada (hereinafter referred to as “the Code”) makes it illegal to gamble within Canada unless the activity falls under sections 201, 202 and 206 of the Code. Operation of legalized gambling falls under the jurisdiction of the provinces and territories. With the expansion of Internet gambling, an amendment to the Code permitted provincial governments to expand their control on gambling. Internet gambling sites that are available to Canadians must originate in offshore jurisdictions and can operate under foreign licensing and foreign law.
