Directive N.1999/93/ce, Under Italian Law, Concerning A Community Framework For Electronic Signatures (4): Certificates And Certification-service-providers.

The Decree n.10 dated 23rd January 2002 acknowledged in the Italian legal system the Directive n. 1999/93/CE concerning a Community framework for electronic signatures. The Decree deals with different aspects to which it is appropriate to make a through review, among which some concerning the activity and the liability of the certification-service-providers.

The following questions have been addressed in this article:

Is the activity of the certification-service-providers settled in Italy or in another European Community Member State subject to any kind of preventive authorization?
Which government state shall supervise the certification activity?
Which responsibility shall the certification-service-providers settled in Italy take on if they want to issue qualified certificates to the public?
Which responsibility shall the certification-service-providers settled in Italy take on if they want to be accredited?
Which are duties and liabilities of the certification-service-providers? Also, may the certification-service-provider indicate, in a qualified certificate, the limitations on its use or the limit on the value of transaction for which it can be used?
