The Implementation Of The Directive N.2000/31/ce, Under Italian Law, Concerning Certain Legal Aspect Of Information Society Services In The Internal Market, In Particular Electronic Commerce (2)

The Decree n.70 dated 9th April 2003 acknowledges in the Italian legal system the Directive n.2000/31/CE concerning certain legal aspects of information society services in the Internal Market, in particular electronic commerce. The above-mentioned Decree deals with different aspects to which it is appropriate to make a thorough review, among whom some refer specifically to providers.

The following questions have been addressed in this article:

Is the provider subject to information obligations towards the service recipient?
Which are the general compulsory information provided by the Directive and the Decree?
Which are the provider obligations if he practices a regulated profession?
In addition to the general compulsory information, is the provider obliged to give other information?
How shall the provider behave if he sends an unsolicited commercial communication?
