Directive N. 2000/31/ce, Under Italian Law, Concerning Certain Legal Aspcets Of Information Society Services In The Internal Market, In Particular Electronic Commerce (4): The Services Of An Information Society And Their Execution.

The Decree n.70 dated 9th April 2003 acknowledged in the Italian legal system the Directive n. 2000/31/CE concerning certain legal aspects of information society services in the Internal Market, in particular electronic commerce. The Directive aims at developing a single electronic commerce regulation, offering to the CE Member States a regulation for their own nation. The Decree deals with different aspects to which it is appropriate to make a through review.

The following questions have been addressed in this article:

Is it necessary to obtain a prior authorization to perform the services of an information society?
Is the provider liable for the transmitted information?
Is the information society service provider liable for the information stored?
Are there any obligations to monitor the information transmitted or stored by the provider?
