Internet Service Providers Liability Under The Law Of Gibraltar

In Gibraltar, the Electronic Commerce Ordinance 2001, which was passed by the House of Assembly on March 5, 2001 (the “ECO”), provides a regulatory framework for the development of electronic commerce in Gibraltar. The ECO sets forth several regulations aimed at supporting electronic transactions, and notably states the rules applicable to the liability of Intermediaries Service Providers (“ISP.”)

The following questions have been addressed in this article:

How is an intermediary service provider defined under the ECO?
What are the main rules applicable to the liability of ISPs?
What happens when the ISP becomes aware of illegal content?
What is the next step, once the Minister has been notified?
