Classified Information Procedures Act (cipa)

The issue of whether or not the Classified Information Procedures Act (CIPA) is constitutional has been extensively raised. The USA Patriot Bill seeks to amend the CIPA to allow for less control by the judge in determining whether to redact classified information without requiring an adversial hearing. The amendments being proposed to the CIPA would undermine the defendant’s right to be able to see the evidence against him or her in favor of the government’s national security interests and could potentially undermine the rights that have been guaranteed under the Sixth Amendment.
