European Union Prepares New Standard Clauses For The Transfer Of Personal Data To Third Countries

The European Commission is working on a draft of a Commission decision on standard clauses for the transfer of personal data to third countries that do not provide an adequate level of protection for the processing of personal data. These model clauses are planned to be used by companies interested in the transfer of personal data outside of the European Union and the European Economic Area.

The following questions have been addressed in this article:

Which are the countries that have established the adequate level of the protection pursuant to Directive 98/46/EC?
How will new model clauses affect data importers from the United States since the United States has been regarded as a country with the adequate level of protection?
